Abstract

This study examines the system of "Prohibited Degrees of Women in Marriage"   within Islamic Jurisprudence (Sharia), employing a descriptive-analytical approach to extrapolate Sharia texts and deduce their underlying legal rulings. The significance of this study lies in its role in establishing a protective framework that safeguards the family and society from fragmentation, while preserving the sanctity of innate human bonds. It categorizes these prohibitions into two primary classes: permanent prohibitions (based on lineage, affinity, and fosterage/breastfeeding) and temporary prohibitions linked to specific temporal or situational impediments.

The study concludes that such legislation represents a comprehensive preventive system with profound social and medical dimensions. Socially, these prohibitions prevent the overlapping of rights and duties that could lead to the severance of kinship ties and disputes among relatives. Medically, the study demonstrates that expanding the circle of prohibitions directly contributes to protecting offspring from hereditary diseases, congenital defects, and the decline of reproductive fitness often resulting from close consanguineous marriages. The findings affirm that these rulings are not merely ritualistic restrictions, but wise measures aimed at ensuring the birth of resilient generations with physical robustness and sound biological constitution. This underscores that such legislation is entrusted to the wisdom of the Creator, who is All-Knowing of human instincts and their intricate design.
